1. Scope and provider
These Terms of Service (the "Terms") govern the relationship between: Victoria Gonsior, Volksgartenstr. 9, 50677 Cologne, Germany (hereinafter "we", "us", "our") and you, the user or client (hereinafter "you", "your"), regarding the use of our website hosted on Podia (www.victoriagonsior.com) and the purchase of our products and coaching services.
By using our Services, you agree to these Terms. If you are under 18, you are not permitted to use these Services.
2. Description of Services
We offer a range of services and products, including:
Free content: Newsletters, lead magnets, and freely accessible digital resources.
Digital products: Self-paced online courses and digital downloads.
Introductory calls: One-off discovery or strategy sessions.
The Inside-Out Pivot: A bespoke, high-level coaching program.
3. Registration and account security
To access certain Services (e.g., free content), you must create an account via the Podia platform.
You are responsible for providing accurate information.
You must keep your password confidential.
Accounts are personal and non-transferable. Sharing login data to avoid payment is a breach of contract and will result in account termination without refund.
4. Payment and billing
4.1. Pricing
All prices are as stated on the checkout page. Since we are based in Germany, prices include applicable VAT if needed or unless otherwise stated for B2B clients with a valid VAT ID.
4.2. Payment methods
Payments are processed via Stripe or PayPal. For high-ticket coaching programs like the Inside-Out Pivot, we process payment via bank transfer upon manual invoicing.
4.3. Late payments
Access to digital products or coaching sessions may be suspended if payments are not received according to the agreed-upon schedule.
5. Cancellation and rescheduling (Coaching Services)
Notice Period: Sessions (including Intro Calls and Pivot sessions) can be rescheduled with at least 24 hours’ notice.
Late Cancellations: Cancellations made with less than 24 hours' notice will be counted as used and the fee for that session is forfeited.
Validity: Coaching packages, including the Inside-Out Pivot, have a validity period of 12 months, starting from the date of the first session. Unused sessions after the expiry date are non-refundable.
6. Right of Withdrawal (Widerrufsrecht) for EU Consumers
If you are a consumer residing in the EU, you generally have a 14-day right to withdraw from a contract without giving reasons.
6.1. Digital Products
For digital downloads or online courses, your right of withdrawal expires once we have provided you with access to the content (e.g., via a download link or login), provided you have expressly consented to the start of the performance and acknowledged that you lose your right of withdrawal.
6.2. Services (Coaching)
If you request the coaching to begin during the withdrawal period, you must pay an amount proportional to the services provided up until you notified us of your withdrawal.
7. Professional Disclaimer (Coaching vs. Therapy)
Our coaching services, including the Inside-Out Pivot, are action-oriented processes focused on personal development and strategy.
Not therapy: Coaching is not a substitute for psychotherapy, medical advice, or psychiatric counseling.
Client responsibility: You are the expert of your own life and business. Results depend on your active participation and implementation. We do not guarantee specific financial or personal outcomes.
8. Intellectual Property
All content provided (videos, PDFs, worksheets, frameworks) is the intellectual property of Victoria Gonsior. We grant you a limited, non-exclusive, non-transferable license for your personal, non-commercial use. You may not record sessions, use session recordings or notes other than for your personal use, distribute materials, or "white label" our content without written consent.
9. Limitation of liability
We are liable for damages caused by willful intent or gross negligence.
In the event of slight negligence, we are only liable for the breach of an "essential contractual obligation" (an obligation that is fundamental to the execution of the contract).
We are not liable for technical interruptions caused by Podia, Stripe, Google or your internet service provider.
10. Governing law and jurisdiction
Governing law: These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Jurisdiction: If you are a business/merchant, the exclusive venue for all disputes is Cologne, Germany.
Consumer protection: As a consumer, you are entitled to the protection of the mandatory provisions of the law of the country where you have your habitual residence.
11. Modification of Terms
We reserve the right to update these terms to reflect changes in our services or legal requirements. You will be notified of significant changes via email or a notification on the Site.
